These Terms establish a binding legal agreement between you ("you", "your", or "User") and the company, covering your use of Shamixo FM — encompassing the web application, Android app, iOS app, and any related services offered now or in the future.
The agreement clarifies usage expectations, protects both parties' rights, and covers software, support services, community platforms, and future features. Users accept these Terms by creating an account or using the services. Creating an account, using the services, or clicking "I Agree" confirms understanding and acceptance. Users invited by others (such as Super Admins) accept by first using the service. Minors require parental consent. The company may update these Terms with email notification, and continued use indicates acceptance.

Most features require an Account, created by you or a Super Admin. You agree to provide accurate, complete, and up-to-date information and to maintain its accuracy. The company bears no responsibility for issues stemming from inaccurate or outdated Account details.
Users are responsible for all Account activity. Super Admins bear responsibility for the actions of users they create. Keep credentials secure and report suspected unauthorized access immediately to admin@nishmira.com. The company is not liable for losses from unauthorized Account use resulting from user negligence.

Shamixo FM operates on a subscription model with pricing listed on the website or apps. Prices are in specified currencies and may vary by location, taxes, or promotions. Subscriptions recur (monthly, annually, or otherwise) until cancelled. The company reserves the right to update pricing with prior notice, effective from the next billing cycle.
Payment methods displayed at checkout may include credit cards, debit cards, online gateways, or approved channels. Users authorize the company to charge their chosen method for subscription fees and taxes. Failed payments may result in access suspension until settlement.
All subscription fees are non-refundable once paid unless otherwise stated in promotions or legal requirements. All rights, title, and interest in Shamixo FM — including software, design, interface, graphics, features, and underlying code — are exclusively owned by Nishmira Technologies Private Limited. Trademarks, logos, and brand names are legally protected and cannot be used without prior written consent.
The company grants a limited, non-exclusive, non-transferable, revocable license to access and use Shamixo FM for internal business or personal purposes in accordance with these Terms. This license does not permit users to copy, distribute, or modify the software; resell or sublicense Shamixo FM; or create derivative works.
Data, files, and materials uploaded or created by users remain their property. By using the Service, users grant the company a worldwide, royalty-free license to store, process, and display content solely for operating and improving the Service.
Suggestions, feedback, or improvement ideas may be used by the company without compensation obligation, becoming company intellectual property.
Shamixo FM may integrate with third-party applications, APIs, or services (such as mapping, IoT platforms, payment gateways, or communication tools) to enhance functionality. These services are not owned or controlled by the company, and the company bears no responsibility for their content, security, or performance. Enabling integrations authorizes the company to exchange relevant Customer Data with those services as needed; the company is not liable for data misuse by external providers after it leaves company systems. Users may enable or disable integrations at any time — disabling stops future data sharing but does not delete previously shared data.
Users may cancel subscriptions at any time through account settings or by contacting admin@nishmira.com. Access remains active through the current billing cycle, after which the subscription does not renew. No refunds are issued unless specified in the Refund Policy.
The company may suspend or terminate accounts with or without prior notice if Terms or linked policies are violated, subscription fees remain unpaid, user actions pose security/legal/operational risks, or it is required by law or government order.
Upon account termination, the right to Service access immediately ends, the company may retain data briefly as required by law, and data is subsequently deleted or anonymized.
Certain provisions — including Intellectual Property Rights, Limitation of Liability, Indemnification, and Governing Law — survive termination.
Shamixo FM is provided "as is" and "as available," without any warranties, express or implied. To the fullest extent permitted by law, all warranties are disclaimed, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the maximum extent permitted by law, Nishmira Technologies Private Limited, its directors, employees, agents, and partners are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, data, goodwill, or business opportunities, arising from or related to Shamixo FM use.
Total cumulative liability for claims arising from or related to Shamixo FM use does not exceed the total subscription fees paid in the twelve (12) months preceding the claim-giving event.
Users agree to defend, indemnify, and hold harmless Nishmira Technologies Private Limited, its directors, officers, employees, agents, and affiliates from claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from:
